In terms of material management, metadata management should be incorporated into the workflow at the material creation stage, instead of being remedied after upload. If enterprises cooperate with advertising agencies or freelance designers, delivery requirements shall clearly specify whether materials contain AI-generated elements, who is responsible for labeling, and how liabilities are allocated.

Regarding record retention, as law enforcement partly hinges on intent and awareness, companies should systematically archive documents including creative briefs, AI prompts and production specifications.

For instance, if a material is explicitly designed to feature mannequins, cartoon characters or abstract avatars, relevant records can serve as evidence that there was no intention to create the impression of real human performers.

When selecting creative approaches, different solutions come with varying costs and disclosure requirements. The hybrid production strategy of “real human models paired with AI-generated backgrounds” generally does not trigger the synthetic performer rules, which may become a viable option for some brands to balance efficiency within the compliance framework.
